So sad. He was so young. Steve Kurtz , a well-known attorney and manager in the music biz, has passed away. Steve reportedly lost his battle with metastatic kidney cancer shortly after Christmas. He was 48. Steve was best known as the manager that started Christina Aguilera's career, but then had a falling out with the singer, who subsequently sued him for fraud. All in the past now. We're sure his family would want him remember in a better way. We send our condolences to his family and friends who will surely miss him.

Sad! People Of Color Shut Out Of All Major Oscar Nominations!

This is very unfortunate and disappointing. Despite some very talented individuals receiving well-deserved nominations this year for Academy Awards, ZERO people of color were recognized in any of the major categories - including acting, writing, and directing! Such a shame! It Was Bound To Happen (UPDATE: But It's Not Going To Happen)

Since most of Hollywood is sneezing out babies everywhere, it was only a matter of time before Jennifer Foreveralone-iston gets in on the dirty diaper action. CORRECTION: It was only a matter of time before a magazine reports that Jennifer Aniston is getting in on the dirty diaper action. Star Magazine is saying that Jennifer has made space in her Cabbage Patch nursery for a real-life baby friend from Mexico!!! Mexico is Jennifer's favorite locale to sun her nipples while miserably weeping into a Corona bottle, so it's the perfect place for her to get a baby of her very own. And apparently, Jennifer volunteers at an orphanage there. A source claims Jennifer has already signed the adoption papers. Jezebel has the issue and they broke it down:

In between yoga on the beach and drinks in the cabana, she likes to volunteer at one specific orphanage, Casa Hogar Sion in Tijuana, and the orphanage director calls her a "friend." According to the mag, Jen has already signed papers to adopt a child, and the kid will be in her arms by her 42nd birthday on February 11th. We don't know for sure that the baby is coming from Casa Hogar Sion, but the director says "no comment," which, in celebland, totes means yes!

Jen already has a gender-neutral nursery in her Beverly Hills home, with a Harry Potter mural on the ceiling.

I won't believe a word of this until I see a tiny Asian boy in painter overalls sashaying out of Jennifer's Beverly Hills home just as I hear her screaming after finding out that her "Harry Potter" ceiling mural is actually a giant portrait of Maddox winking.

But if it is true, I really hope Jennifer fulfills my lifelong dream of a celebwhore naming their baby CONCEPCI�N. Jen's supposed baby is coming from Mexico, so it fits. And Concepci�n Cool Aniston really does have a nice ring to it.

UPDATE: Shit. Just as I hit publish, Jennifer's rep told People that Star Magazine must have ripped this story out of her dream journal, because it's not true at all.

"I'm bewildered," Robert Plant said onstage as he accepted the Grammy Album of the Year award with Alison Krauss on Sunday night. "In the old days we would have called this selling out, but it's a good way to spend a Sunday."

He was probably one of the few who were surprised, because Raising Sand, which won five trophies at Sunday night's show, is in many ways the perfect Grammy album. It features two respected veterans, a critically lauded producer, some sandpaper-and-velvet vocals and a baker's dozen of time-tested standards.

You're probably familiar with Robert Plant from his Led Zeppelin days, and you might be aware of producer T-Bone Burnett's work on the "O Brother, Where Art Thou?" soundtrack (it won the Grammy for Album of the Year in 2002). And if you don't know who Alison Krauss is, she possesses a haunting set of pipes and is one of the meanest fiddle players in the world. Oh, and she's won 21 Grammys, more than any other female artist and the seventh-most in history.

Really, she's the key to Sand's success, and not just because of her voice (or her fiddle playing). She and Plant first met in 2004, at a Rock and Roll Hall of Fame tribute to legendary bluesman Leadbelly, and the former Zeppelin man was amazed by her knowledge of American Roots music — so much so that they began kicking around the idea of recording an album together. Three years later, Sand was released.

And while Plant possesses the more famous voice, the album's finest moments radiate from Krauss. Whether she's getting bluesy on Little Milton's "Let Your Loss Be Your Lesson" or entwining with Plant's husky voice on songs like "Please Read the Letter" and Roly Salley's winsome "Killing the Blues," she more than carries her end of the bargain.

And perhaps that's also due to producer Burnett, who handpicked the 13 songs the duo cover on Sand. His arrangements are sparse — giving the two voices ample room to breathe — yet dense, warm and crackling at the same time. It's a testament to his work that he's often given just as much billing as Plant and Krauss on the project ... and it's certainly justified.

To date, Sand has sold more than 1 million copies, heaped tons of acclaim and actually earned a Grammy last year — "Gone Gone Gone (Done Moved On)" took home the award for Best Pop Collaboration With Vocals.

One expert was surprised not by the album's success, but by the fact that it's actually quite a good album.

"At first, the album seemed like a vanity project. ... Two names, clearly a one-off record, didn't have to be any good, you know?" New York Times music critic Jon Caramanica said. "Led Zeppelin fans would buy it because of Robert Plant, Alison Krauss would get a check. But it actually turned out to be a really thoughtful, really good record. So when you combine all that with the fact that the Grammys love to lionize one of their own, I could really see it taking home some awards."

Ke$ha Sued By Former Managers

DAS Communications' lawyer claims producer Dr. Luke convinced her to breach contract.

Ke$ha is being sued by her former managers at DAS Communications for upwards of $14 million, Ken Freundlich, who is representing DAS in the case, confirmed to MTV News.

"DAS was Ke$ha's manager since the beginning of 2006, and there was a written agreement, and they worked closely, and sometime in September 2008 [producer] Dr. Luke, for his own personal gain, somehow induced her to breach that contract," Freundlich said. "And she unceremoniously terminated DAS without justification and then ended up with Luke, basically. So we sued Ke$ha for breach of contract and Luke for interference, and that was last year, and the defense's reaction was to try and delay us. They made motions.

"The judge denied all their motions, and now we're going forward. We're going to have our day in court," he continued. "And we're going to prove that Dr. Luke induced her to breach the contract. She had no right to do so, and we're gonna get damages from her."

Freundlich explained how he and his team came to the $14 million sum, explaining, "We don't know exactly how much, but we assume it's in that range. She's been quite successful. The case is set. It's gonna go on the rest of this year. We're gonna go straight to the trial if we have to."

Ke$ha has filed a suit in California against the management team, but Freundlich is confident nothing will come of her claim that they acted as an "illegal talent agent." "That's pending out in California. Even though that case is still pending, I don't think it has any merit," he said.

Calls to Ke$ha's legal team and rep were not returned to MTV News by press time.

Let's get right into the five best moments from Monday night's (January 17) "Jersey Shore":

5. I Have a Dream
So, we got a bonus episode this week, and on Martin Luther King Jr. Day, no less — just in time for Snooki and Pauly D to liken their contrasting tans to "jungle fever." Yikes.

Perhaps we should focus on drunk Snooki eating a raw potato instead!

4. Snooki and Seabiscuit
Vinny says, "We have this thing with Snooki that, when she drinks, you don't know what's gonna come out of her mouth" — but that works both ways.

Like that time, five seconds later, when she crawled into Vinny's bed in order to get some action from "Seabiscuit." Oh, right, that's Snooki's nickname for Vinny's manhood. Why hasn't this show won an Emmy yet?

3. Drunk Deena
Speaking of drunk people, Deena was kicked out of a club after falling off a stage. As security carried her out, she drunkenly slurred to them, "I'm fine. I'm fine."

No, really, she's fine. She's on "Jersey Shore"! MTV pays her more the drunker she gets! It's all good.

2. JWhoa, What the Hell Is JWoww Doing?!?
Speaking of other drunk people, JWoww decided to relieve herself behind a bar. Seriously. But, you know, she rinsed the area with a soda gun, so, "It doesn't smell anymore."

Note to self: Never order a beer upstairs at Karma.

1. Snooki Gets Arrested ... and Remixed
Snooki was basically a drunken mess the entire episode, and it was music to my ears. So I think now's a good time for a "Jersey Shore" r-r-r-r-REMIX! Check out the embedded video for a musical breakdown of Snickers' sauced shenanigans, including a 10 a.m. beer bong and body shots with a 65-year-old man. You will not be disappointed.

Harlem, stand up! The Diplomats are reunited and the Uptown collective — Cam'ron, Jim Jones, Juelz Santana and Freekey Zekey — are set to bring their revived outfit to 1515 where they'll be our guests on "RapFix Live." Dipset will kick off the second season of MTV News' hip-hop live stream show on Thursday at 4 p.m. ET on MTV.com.

After an internal spat caused disruption among the charismatic crew, they slowly began repairing the damaged relationships. In February 2009, Cam'ron told MTV News that he and Jones had spoken for the first time in years. From that point on, the two childhood friends inched closer to a reconciliation that eventually resulted in their comeback concert this past November.

"It's a good feeling," Jones explained to MTV News about the crew's new mindset. "Everybody just comes to the table with their best. It's brotherly competition so it only makes it better. Above all, we came back together for the brotherhood. We grew up together, so there was a love that was lost there. We regained that and it's time for music."

The Dipset members will sit down with Sway to discuss the status of their comeback, from their forthcoming mixtape to their rumored deal with Interscope Records.

"Shout-outs to Dre, that was the most incredible experience in my career," Jones said shortly after a flick of Dipset working with the West Coast producer appeared online. "Dr. Dre came to our studio, which was even more incredible. That was dope. We got to do a few songs with him. He coached me a bit."

Joe Jonas Wants Fans To Dance To His Solo Album

'They've been wanting this for me for a long time,' he tells MTV News of support from Jonas Brothers Nick and Kevin.

The Jonas Brothers always seem to stand by one another, even if that means stepping away from the trio to try out new projects. Last year, Joe and Kevin gave Nick their blessing when he released a solo LP. And now that Joe is working on new music, his brothers are showing him the same support.

"I think there's a lot of emotions that I feel about doing my solo project. I think I was nervous in the beginning," Joe told MTV News when we visited him and producer Danja at the studio.

"I wanted to have my brothers' support, and the fact they're both so excited for me and they've been wanting this for me for a long time [is great]."

As part of Nick Jonas and the Administration, Nick released the bluesy, pop rock album Who I Am in 2010, but Joe's project will likely have a different sound.

"To be able to go on a musical journey for a while and finally, with finding Danja and working with him, we've been able to collaborate on something that really works for me," Joe explained. "And [to] find me and not try to mold it into something it's not, to try and be myself and my music and kind of tell stories and be honest and just have something ... [that] when people hear it, hopefully they'll be able to dance to it and have a good time."

While their solo musical directions may differ, Joe said he learned some things from Nick.

"I think the biggest thing that I saw from [Nick], he just had a good time," he said. "He made a record that was for him and this one is for me and my fans. To be able to get in here everyday and just vibe out, we're all just having a great time in here. The biggest piece is that I'm on the journey. ... It's just gonna be a fun vibe to everything."

Drummer admits he doesn't know what will come of 'new material.'

On Friday morning, mere hours before he was due to take the stage with classic rockers Foreigner at Detroit's GM Renaissance Center, drummer Jason Bonham — the son of late Led Zeppelin kitman John Bonham — told Jim Johnson and Lynne Woodison of local rock station 94.7 WCSX that he'd be an ex-member of Foreigner as of September 1. But that's not the only thing he said.

Much to the delight of Led Zeppelin fans everywhere, Bonham revealed that he's been meeting up with Led Zep guitarist Jimmy Page and bassist John Paul Jones in recent months and that they've been "trying to do some new material and writing."

It was the first time since Led Zeppelin announced they would re-form for a single performance (which happened late last year at London's O2 Arena, in honor of the late Ahmet Ertegün, who signed the band to Atlantic Records in 1969) that anyone connected to the band has confirmed publicly that new music could be on the horizon for the iconic rockers. While the bandmembers have stopped short of definitively ruling out such a reunion, singer Robert Plant insisted in the wake of last year's show that he intended to focus on promoting and touring behind his critically lauded album with bluegrass artist Alison Krauss, Raising Sand.

Not that Bonham knows what — if anything — will happen with the new material he's been working on with Page (who collaborated with pop singer Leona Lewis on an uneven version of Zep's "Whole Lotta Love" at the Olympic closing ceremonies in Beijing on Sunday night) and Jones. He said he just shows up and takes his seat behind the kit.

"I've been over [to England] a couple of times," Bonham said. "I've been working with Jimmy and John Paul and trying to do ... some new material and some writing. I don't know what it will be, but it will be something. At the moment, all I know is I have the great pleasure to go and jam with the two guys and start work on some material. When I get there, I never ask any questions. If I get a phone call to go and play, I enjoy every moment of it. Whatever it ends up as, to ever get a chance to jam with two people like that, it is a phenomenal thing for me. It's my life. It's what I've dreamed about doing."

He said it's still too early to tell what will become of these "jam" sessions, but admitted that the "possibility of doing something is in the cards. I really felt it was in the cards from the moment we walked offstage at the O2." Bonham also explained that, before there could be a Led Zep LP, "lots of politics [would need to] get ironed out," but added that recording with Zep is "something I've always wanted to do."

Bonham noticeably didn't mention frontman Plant's name during the discussion. A spokesperson for Page's management had no comment on the matter, and a spokesperson for Jones' management could not be reached by press time.

Stone Temple Pilots Reunited In Hopes Of Opening For Led Zeppelin, Bassist Says

'If time allows, there will definitely be new music,' Robert DeLeo adds of STP's future.

There are a number of reasons why Stone Temple Pilots decided to reunite after nearly five years apart — some are obvious, and others, not so much.

Of course, the financial windfall of reviving the grunge stalwarts for an extensive U.S. tour was too good to pass up, and bassist Robert DeLeo readily admits as much. And then there are the fans, the ones who had been with STP since the very beginning as well as those who discovered the band only after it first split back in 2003 and who, woefully, have yet to catch the Pilots live.

On a more personal level, though, Stone Temple Pilots' resurrection was purely selfish, and very much an anticipatory (not to mention optimistic) move on the band's part: If, after the months and months of rumors and denials, there ever is a full-on Led Zeppelin reunion tour, STP wanted to be ready to offer their services as an opening act.

"Believe me, that was one of the reasons," laughed DeLeo. "We thought, 'We should get together now, in case Zeppelin does tour.' I'm serious, man. That would be one hell of a bill: STP and Led Zeppelin. I mean, we could play a doghouse, out in the middle of the ocean, and if I got to play with Zeppelin, that would be a highlight of my life."

Yes, DeLeo — and the rest of the band — had several reservations about raising STP from the dead — a feat DeLeo jokingly referred to as "Mission Impossible." For the band's members, the idea of regrouping was terrifying at first, but with time, the boys settled their differences and tried to think positive.

"For me, it was about putting down some of the things that I was used to getting bitten by," explained the bassist — who, with guitar-playing brother Dean DeLeo, has been collaborating with Peter Frampton on material for his next LP. "After you get bitten, it's hard to go back. I wanted to go into this with an open frame of mind and a positive attitude and just have fun with it. We should have fun with it, which God knows we didn't always have with our career when we were younger. If that's all I can say, and that's what I can get out of this reunion, great.

"I think I speak for all of us when I say there's a lot of unfinished business that we didn't get around to the first go," he continued. "Enough time has gone by, and it feels really good to be back. I don't really want to put too much thought into how it feels — I'm just kind of going with it and keeping a good positive attitude about it. I just needed to get over the things that we all needed to get over, and that's been working so far. If everyone shows up and does this thing, I think it's going to be really amazing."

DeLeo claims that during recent rehearsals, STP were "sounding as good as ever," and he credits sobriety as part of the reason the band's in tip-top shape.

"My brother's going on four years of sobriety," he said. "We have a lot more clarity in the band now, and I think with clarity comes appreciation. I saw that the other night, when we played [a secret gig in Los Angeles]. I saw it in my eyes, and in the eyes of the rest of the band. There's a lot more rock in this band now."

As for an STP record, DeLeo is not 100 percent sure that's going to happen. The goal for STP over the next few weeks, he said, is to reacquaint themselves with their songbook and prepare for their return to the road. Once the band is back in that mindset, the bassist said new STP material is very possible.

"I've always got stuff written, and there's always a long list of songs that are always there — it's a matter of timing," DeLeo said. "If time allows, there will definitely be new music. I think it would be silly not to release new music. I'd like to believe we still have a writing relationship, but the first step is getting reacquainted with what we know."

While STP were on hiatus, frontman Scott Weiland teamed up with Velvet Revolver, and the DeLeo brothers joined forces with Filter's Richard Patrick for Army of Anyone — who are now on hiatus after releasing a poorly received self-titled LP. Does DeLeo foresee an AOA reunion somewhere down the line?

"You never know," he said. "It's just like STP — I didn't know if I was going to return. Whether we get back together and do anything, I think we made a great record, bottom line. That's all that matters to me. If we make another one, I want to make sure it's great, and that applies to STP and anything I do. But I was pretty heartbroken over [the feeble response to AOA's album]."

I thought my mornings were hectic and all I have to do is Fabreze the pee spot I left on my bed and wipe the dried-up tears off my face with a Clorox Wipe.

In this week's edition of Perfect Rich White Woman Weekly, Fishsticks and two of her friends (Juliet de Baubigny and Stella McCartney) document a day in the life of a working mother. Yup, THIS BITCH just doesn't know. You can read the entire mess over at GOOP, but here's a few dingles. Read it while farting out the chorus to "I'm Every Woman."

Got Apple all fed and dressed in her uniform and ready to go but no sign nor sight of Moses at 8 am and we have to be out of the house by 8:20. I went up to arouse the little man from slumber and he quite happily got up and crawled into my arms. We got downstairs and I made him a quick breakfast of eggs and toast followed by a spoonful of lemon flavored flax oil that I try to remember to give them both every morning.

When all was well I dodged off as fast as possible but was still late to the 9 am workout. Did dance aerobics for 45 minutes then all of the butt lifts and the like. Rushed upstairs to have a shower, doing my post workout stretch while the conditioner was doing its magic on my hair to combine activities/save time.

Got home and had a fitting with super stylist Elizabeth Saltzman for the upcoming Nashville trip (what to wear, what to wear?) from 1-2. This is my 4th out of 5 fittings for this trip. We tried on a myriad of dresses and outfits, and I had b.o. by the end of it from wrestling with all of those dresses.

At 4pm, my weekly owners' and managers' call takes place for the Tracy Anderson Method with our brilliant CEO Stephanie Stahl taking the lead. I basically listen and try to learn. Kiddies burst through the door and play in my office while I finish up, just drawing and hanging out and of course playing Plants vs Zombies on the iPad, their obsession that I have to limit like crazy! What up, gamers. Then downstairs to make cupcakes for tomorrow?s bake sale. It is ?Bonfire night? in the UK tomorrow and the bake sale is to celebrate and to raise money for charity. We decide on vanilla cupcakes with pink icing and green icing (from Tate?s Bakeshop cookbook with the icing from American Desserts cookbook).

The kids indulge in a super sugary cupcake before bed but I don?t feel too bad because they had a brown rice stir fry for dinner with baked sweet potato on the side. It?s all about balance! My night to lay with Mosey so I tuck Apple in, say a prayer and go into Mosey's room for a story, foot massage and quiet time. As soon as all was quiet, I rushed downstairs to grab a blazer and some blush and flung myself in the car for girls night.

Fishy also lists a few tips for saving time which include:

1. Schedule your time well. When I know what I am doing from hour to hour I get more done. Write it all in the day?s calendar, what you want to accomplish and in what time frame.

3. I cook a lot, especially on the weekends, so I like to plan a rough menu for the whole weekend and get the food in on Friday. Obviously stores and websites that deliver make this a dream. In London I use Ocado. Also James Knight, my favorite fishmonger, will deliver. Having all of the ingredients means I'm prepared even when I don't think I am.

4. I always lay the kids uniforms and school things out the night before once they are asleep. When it?s quiet I can check the "kid list" for show and tell items to bring in, consent forms, ballet kit, etc, so that the morning is less of a scramble.

But Fishy missed a very important tip: Make sure you come flying out of a wealthy lady's vagina at birth (or marry a millionaire), so that later on in life you can hire a team of nannies to take care of your kids while you write ALL THESE FUCKING LISTS OUT.

And it's a real shame that working mothers can't read Fishy's pearls of wisdom since they are too busy working a fucking second job to put generic peanut butter on the table.

Eminem is back in more ways than one. The Detroit lyricist is reviving his Shady Records company, and Wednesday (January 12) he announced the signing of two new acts: underground supergroup Slaughterhouse and upstart rapper Yelawolf. Cashis and D-12 remain on the roster, but Em made no secret of wanting to bring new life to his company.

"Yelawolf and Slaughterhouse, it's kinda phase two of Shady," Eminem explained in a statement. "It's the new generation of Shady Records, and as we're trying to rebuild our label, it's exciting for hip-hop, and with all of these forces coming together and with what everybody's capable of on the mic, it's gonna be fun."

The four-man Slaughterhouse collective — Joe Budden, Joell Ortiz, Crooked I and Royce Da 5'9" — was in talks with Shady Records for longer than a year working on the deal.

"I been answering that question for a year and change, ever since that Drake 'Forever' music video," Budden told MTV News during an appearance on "RapFix Live," citing a scene where the group stands behind Em during his verse. "It's like, Eminem is a whole nother entity. The guy is nominated for 10 Grammys."

Southern rhyme slinger Yelawolf is backed by music industry veteran Kawan "KP" Prather, who inked an upstart T.I. to his first deal and helped Usher on the superstar's Confessions album.

"Considering where I'm from and the sh-- I've been through, it's hard to put into words what partnering with Shady means to me, my team at Ghet-O-Vision and my state of Alabama," Yela said in prepared remarks.

"I can tell you that when you're willing to give your life up to see a dream through, the reward is great," he continued. "And now that I've become an apprentice to one of the greatest artists in the world, my potential reaches beyond anything I ever imagined. Let's kill this sh--."

Both acts are expected to deliver projects in the coming months.

Jay-Z and Kanye West dropped their first single, "H.A.M.," on Tuesday, but their record may have overshadowed another "ham" song: Yung Joc and Gucci Mane's "Going Ham" leaked over the weekend.

The tracks aren't related, nor do they have anything to do with a choice cut of pig: The Jay and 'Ye song name is actually an acronym that stands for "Hard As a Mother----er," while Joc and Gucci's version is based on the Atlanta term "going ham," which is a derivative of mayhem. Joc admits most people may not even know the term's origin.

"I think people don't realize it," he explained. "You take a word and cut it down; we've got nicknames for everything. The average person, they don't know what it means; they just hear the saying. They understand the understanding of the word: Everybody is going crazy, having a good time, 'going ham.' "

Joc, who wasn't at all bothered by the song titles' similarities, said he and Gucci had been kicking it a lot recently, even though they didn't have a chance to go to the studio to record. He sent Gucci a record, which eventually became Joc's second single, "What She Like," but he didn't think Gucci's verse fit the song.

"I ended up calling Yo Gotti, and Yo Gotti got on the record," Joc said. "[He] followed the idea of where we were going with the record."

But a song just right for a Gucci collaboration did come along.

"I went in with Ike Dirty, Isaac Hayes' son, and when he first played the beat I said, 'Man, I swear this sounds like something that could be for Gucci,' " Joc remembered. "And I was just sitting there listening: 'Man, that's crazy. I already got a record with him, but I could use his verse for this.' In the studio, we played around with it for a little bit. It synced up, and I was like, 'Hell yeah, let's go with it.' "

Joc said he didn't know who leaked "Going Ham" or how they did it.

"That's not even a mixed version or a complete version because we got a lot more drop and a lot more sound effects with the record, but y'all got it now," he said. "Y'all calling me about it."

Britney Spears' 'Hold It Against Me' Likely Safe From Copyright Case

Country music duo the Bellamy Brothers are upset over Britney song title's resemblance to their 1979 hit.

Chances are, nobody out there is going to confuse the Bellamy Brothers' slow-rolling, 1979 Tex-Mex country hit "If I Said You Have a Beautiful Body Would You Hold It Against Me" with Britney Spears' new club grinder "Hold It Against Me."

Yeah, the titles are somewhat similar, but even with the noise the "Let Your Love Flow" sibling act is making over a possible legal challenge to Brit, the chances of winning a case over the borrowing of a song title is pretty slim, according to a noted copyright attorney who spoke to MTV News.

"A title is not copyrightable," said lawyer Brian Caplan, who has more than 20 years of experience in intellectual property and entertainment law. (Caplan does not represent the Bellamy Brothers.) "The expression, either in lyrics or music in a composition is copyrightable, however if something has been used previously by multiple sources, one can argue that it is trite or commonplace and the latter user has no right to it."

David Bellamy conceded to Entertainment Weekly that he first heard the title phrase — a favorite cheesy pick-up line for bar-trollers across the globe — while watching reruns of the classic Groucho Marx show "You Bet Your Life." The mustachioed comedian used the line on the show one night in an attempt to sidle up to a buxom blonde, Bellamy recalled.

"It was just really funny, and I thought, 'Well, that'd make a really good song title," Bellamy said, acknowledging that many songs have the same, or similar, titles these days. "But this particular title is kinda hard to disguise, because the title is the song. It's not like saying, 'I love you, baby.' I think songwriters have become watered-down. This makes me sound like an old man again, but I find that songwriters now are not as strong as they used to be in the '60s or '70s."

Lawyer Caplan, who had not heard either song when MTV News contacted him to comment, said that just because a title is not copyrightable does not mean a potential case would automatically go away. "It means that there would be a strong argument as it moves forward to have it dismissed, though," he said. "If you can show through a survey of prior art that that phrase has been used previously by others prior to the plaintiff's use, then it significantly undermines [the case] and if it's only used in the title it's a slam dunk."

As an example, he said if someone wrote a song called "Jersey Girl" or "My Jersey Girl," despite the fact that Rock and Roll Hall of Fame Inductee Tom Waits wrote his "Jersey Girl" in 1980 — and Jersey boy Bruce Springsteen helped popularize it a year later — as long as the rest of the song is different musically, lyrically and melodically, there would be no case there, either.

In the meantime, Spears is burning up the charts with her tune and breaking some records along the way. "Hold It Against Me" immediately shot to #1 on iTunes upon release this week and broke all previous records for most spins upon its release on Monday.

Taylor Swift Tops Billboard Again In Slow Sales Week

Singer's Speak Now notches lowest #1 figures in SoundScan era.

Taylor Swift has smashed a host of records in her short career, but next week the 21-year-old, newly single star will notch another one that probably won't land in her bio. In a dismally slow week on the Billboard albums chart, Swift's Speak Now held on to the #1 spot again while posting the lowest totals ever for a #1 album in the SoundScan era.

According to SoundScan, the disc moved 52,000 copies, which helped vault it over the 3 million mark, but also broke the dubious record set by the soundtrack to the movie "Dreamgirls" in January 2007, which had the previous #1 low at 66,000.

Only one new title moved into the top 10, the soundtrack to Gwyneth Paltrow's "Country Strong," which came in at #10 on sales of 28,000 after climbing up from the #149 slot in its first week.

The rest of the top 10 suffered double-digit percentage losses, including: Nicki Minaj, Pink Friday (#2, 39,000); Bruno Mars, Doo-Wops & Hooligans (#3, 38,000); "Tron Legacy" soundtrack (#4, 34,000); Eminem, Recovery (#5, 33,000); Rihanna, Loud (#6, 33,000); Kanye West, My Beautiful Dark Twisted Fantasy (#7, 33,000); Mumford & Sons, Sigh No More (#8, 31,000); and Jason Aldean, My Kinda Party (#9, 29,000).

The Black Keys got a major bump before their "Saturday Night Live" appearance, moving up 12 spots to #14 with Brothers (25,000), which pushed the band over the 500,000 mark. Meanwhile, Jamie Foxx's latest, Best Night of My Life, slid a bit more, dropping five spots to #16 on sales of 23,000.

"Country Strong" fared much better on the iTunes album charts, coming in at #1, followed by the Black Keys, "Tron," Mumford & Sons, West, Mars, Swift, Rihanna, a second "Country Strong" soundtrack compilation and Eminem. The iTunes singles chart was topped by Mars' "Grenade," followed by Katy Perry's "Firework," Enrique Iglesias' "Tonight," the Black Eyed Peas' "The Time (Dirty Bit)" and Wiz Khalifa's "Black and Yellow." Though iTunes doesn't provide sales figures, it was also a good week for Ke$ha, who came in at #6 with "We R Who We R," followed by Lil Wayne's "6 Foot 7 Foot," Pink's "Raise Your Glass," Rihanna's "What's My Name" and Waka Flocka Flame's "No Hands."

Things will probably stay mostly steady again next week with just a few new releases, including the latest from ornate rockers the Decemberists and albums by Cake, Cage the Elephant, James Blunt and the Script.
